TERMS OF SERVICE

Key points: ECUtilities is a vehicle-information and recording tool, not a substitute for attentive driving, professional diagnosis, repair advice, emergency services, or compliance with local law. ECUniverse is a moderated vehicle community. You remain responsible for your driving, recordings, uploads, vehicle decisions, and account activity.

1. Agreement and operator

These Terms govern ECUtilities, ECUniverse, related websites, account services, cloud synchronization, and associated features operated by DriftLine Media Inc. of Ontario, Canada (“DriftLine,” “we,” “us,” or “our”). By creating an account, accepting these Terms, or using the services, you agree to these Terms, the Privacy Policy, Community Standards, and Recording & Location Notice.

2. Eligibility

You must be at least 16 years old and legally able to enter this agreement. Do not use the services if their use is prohibited where you live or where you are driving.

4. Safe use while driving

Do not interact with ECUtilities or ECUniverse in a way that distracts you from driving. Configure dashboards, cameras, gauges, profiles, posts, and settings only when safely parked or when a passenger is operating the device. Obey all traffic, distracted-driving, recording, privacy, and device-mounting laws. DriftLine is not an emergency, collision-warning, navigation-safety, or driver-assistance system.

5. Vehicle information and diagnostics

OBD data, diagnostic codes, calculated values, performance estimates, maintenance information, gauges, alerts, and vehicle-health summaries may be incomplete, delayed, unsupported, inaccurate, or affected by the vehicle, adapter, device, connection, calibration, sensors, third-party data, or user configuration. Confirm safety-critical information with the vehicle manufacturer, a qualified technician, and appropriate equipment before driving, repairing, tuning, clearing codes, or relying on a displayed value.

6. Dashcam, camera, microphone, and location

Use of recording and location features is also governed by the Recording & Location Notice. You are responsible for obtaining any consent required from passengers, employees, bystanders, or property owners and for using recordings lawfully. Screen capture may record everything visible in the captured ECUtilities display, including camera views, gauges, overlays, and controls.

7. ECUniverse and user content

You retain ownership of content you create and upload. You grant DriftLine a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt for technical display, and distribute that content only as reasonably necessary to operate, secure, moderate, improve, and provide the services according to your selected visibility settings.

You represent that you have the rights and permissions needed to upload the content and that it does not violate law, privacy, intellectual property, confidentiality, or the Community Standards. Public and follower-visible content can be copied, photographed, or reshared by other users despite platform controls.

8. Prohibited use

You may not use the services to violate law; endanger people; encourage reckless driving or illegal street racing; harass, threaten, exploit, impersonate, or defraud others; distribute malware; probe or bypass security; scrape private data; misuse reports; infringe intellectual property; or interfere with the services. Political discussion and partisan advocacy are not permitted on ECUniverse. The full content rules appear in the Community Standards.

9. Moderation and enforcement

We may review reports and content, reduce visibility, remove content, restrict features, suspend or terminate accounts, preserve evidence, or contact appropriate authorities where reasonably necessary for safety, security, legal compliance, or enforcement. Moderation decisions may be automated, assisted, or manual. You may appeal moderation decisions through moderation@driftlinemedia.ca.

10. Software licence

DriftLine grants you a limited, revocable, non-exclusive, non-transferable licence to install and use ECUtilities for personal or authorized business use. Except where law permits otherwise, you may not copy, sell, sublicense, reverse engineer, circumvent entitlement controls, extract proprietary assets, or create unauthorized derivative services.

11. Third-party services

The services may rely on providers for authentication, databases, storage, hosting, email, app distribution, billing, and other infrastructure. Their availability and terms may affect particular features. DriftLine is not responsible for third-party services outside our control, but we remain responsible for our own handling of personal information as described in the Privacy Policy.

12. Availability and changes

Closed-test, beta, and developing features may change, fail, or be removed. We may update the services, compatibility requirements, limits, safety controls, and these Terms. Material policy changes will require renewed acceptance where appropriate. Continued use after the effective date of a non-material update constitutes acceptance.

13. Disclaimers

To the maximum extent permitted by law, the services are provided “as is” and “as available.” We do not guarantee uninterrupted operation, compatibility with every vehicle or device, exact sensor values, complete data recovery, permanent storage, or that every harmful or unlawful post will be detected.

14. Limitation of liability

To the maximum extent permitted by law, DriftLine Media Inc. and its directors, officers, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, vehicle damage, personal injury, tickets, collisions, or claims arising from distracted driving, unlawful recording, vehicle modification, diagnostic reliance, third-party services, or user content. Nothing in these Terms excludes liability that cannot legally be excluded.

15. Indemnity

You agree to defend and indemnify DriftLine against third-party claims, losses, and reasonable costs arising from your unlawful use, recordings, uploads, driving conduct, infringement, breach of these Terms, or violation of another person’s rights, except to the extent caused by DriftLine’s own unlawful conduct.

16. Termination and deletion

You may stop using the services or delete your account. Account deletion and limited retention exceptions are described in the Account Deletion & Data Retention Notice. Provisions that by their nature should survive termination—including ownership, licences already required to process deletion, dispute, liability, and enforcement provisions—will survive.

17. Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Ontario will have jurisdiction, subject to any consumer rights that require a different forum.
